Online Store Terms and Conditions
The owner of the online store www.kirna.ee (hereinafter referred to as the Online Store) is Kirna Mõis OÜ (registration code 10938478), located at Mõisa tee 5, Kirna village, Türi municipality, Järva county, 72231.
Validity of Sales Contract, Product and Price Information
The terms and conditions apply when purchasing goods from the Online Store.
The prices of the products sold in the Online Store are indicated next to the products. A delivery fee will be added to the price.
The delivery fee depends on the buyer’s location and the delivery method. The delivery fee will be displayed to the buyer when placing the order.
Information about the products is provided directly on the product page in the Online Store.
Order Placement
To order a product, you must add the desired products to the shopping cart. To complete the order, you must fill in the required fields and select a suitable delivery method for the products. The total fee will then be displayed, which can be paid via a bank link or another payment solution.
The contract enters into force when the payment amount is received in the Online Store’s account.
If the ordered goods cannot be delivered due to the product being out of stock or for other reasons, the buyer will be notified as soon as possible, and the paid amount (including delivery fees) will be refunded immediately, but no later than 14 days after the notification has been sent.
Delivery
Goods will be sent to the following countries:
• Estonia (3-5 days)
The shipping costs are borne by the buyer, and the corresponding price information is displayed next to the chosen shipping method.
Domestic shipments within Estonia generally reach the buyer’s designated destination within 3-5 business days from the conclusion of the sales contract.
In exceptional cases, the right to deliver the goods may extend up to 45 calendar days.
Right of Withdrawal
After receiving the order, the buyer has the right to withdraw from the contract within 14 days.
The right of withdrawal does not apply if the buyer is a legal entity.
To use the 14-day return right, the ordered goods must not be used in any way other than necessary to verify their nature, properties, and functionality, as permitted for testing the goods in a physical store.
If the goods have been used for purposes other than necessary for verifying their nature, properties, and functionality or if they show signs of use or wear, the Online Store has the right to reduce the refundable amount according to the decrease in the value of the goods.
To return the goods, a withdrawal request must be sent via email to pood@kirna.ee within 14 days of receiving the goods.
The return shipping costs are borne by the buyer, except when the reason for return is that the returned item does not match the order (e.g., incorrect or defective item).
The buyer must return the goods within 14 days following the submission of the withdrawal request or provide proof that the goods were handed over to the carrier within the aforementioned period.
The Online Store will refund all payments made by the buyer under the contract upon receiving the returned goods, but no later than 14 days after receiving the withdrawal notice.
The Online Store may refuse to make a refund until the item has been returned or the buyer has provided proof that the item has been returned, whichever happens first.
If the buyer has explicitly chosen a different, more expensive delivery method than the cheapest standard delivery method offered by the Online Store, the Online Store does not have to refund the cost that exceeds the cost of the standard delivery method.
The Online Store has the right to cancel the sale and demand the return of the goods if the price of the goods on the website was significantly lower than the market price due to a mistake.
Right to Make a Complaint
The Online Store is responsible for any non-compliance or defects in the goods sold to the buyer, which were present at the time of delivery and become apparent within two years from the delivery of the goods. If the defect is discovered within the first six months from the delivery, it is presumed that the defect existed at the time of delivery. It is the Online Store’s responsibility to prove otherwise.
The buyer has the right to contact the Online Store within two months of noticing a defect by sending an email to pood@kirna.ee.
The Online Store is not responsible for defects that appear after the goods have been delivered to the buyer.
If the goods purchased from the Online Store are defective, the Online Store will repair or replace the defective item. If the item cannot be repaired or replaced, the Online Store will refund all payments made under the sales contract.
The Online Store will respond to the consumer’s complaint in writing or in another format that allows for a record of the communication within 15 days.
Direct Marketing and Personal Data Processing
The Online Store uses the buyer’s personal data (e.g., name, phone number, address, email address, bank details) solely for processing the order and delivering the goods to the buyer. The Online Store will forward personal data to the delivery service providers to ensure the delivery of the goods.
The Online Store will send newsletters and offers to the buyer’s email address only if the buyer has expressed a desire to receive them by providing their email address on the website and indicating their wish to receive direct marketing communications.
The buyer has the right to unsubscribe from email offers and newsletters at any time by notifying us via email or following the instructions provided in the email containing the offers.
Dispute Resolution
If the buyer has any complaints regarding the Online Store, they should send them via email to pood@kirna.ee.
If the buyer and the Online Store cannot resolve the dispute by agreement, the buyer may contact the Consumer Disputes Committee. The procedure conditions can be reviewed, and the application can be submitted here. The Consumer Disputes Committee has the competence to resolve disputes arising from the contract between the buyer and the Online Store. The examination of the buyer’s complaint in the committee is free of charge.
